a &quot;black box.&quot; It captures a few seconds of information around a crash, and insurers and experts now use AI tools to read and interpret it. That data can prove the other driver was speeding, or it can be turned against you. Knowing how it works helps you protect your case.<\/p>\n<h2 class='kb-h2'>What the black box records<\/h2>\n<p>An event data recorder is not a camera and it does not track you as you drive. It stores a short snapshot of vehicle data tied to a crash event, then keeps that snapshot in memory.<\/p>\n<div class='kb-cite'><strong>What it is:<\/strong> The federal standard at <a href='https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-V\/part-563'>49 CFR Part 563<\/a> defines an event data recorder and lists the data it captures, such as vehicle speed, engine throttle, brake use, seat belt status, and the change in velocity during the crash. The rule specifically excludes audio and video. It records the seconds just before and during a collision, not your daily travel.<\/div>\n<h2 class='kb-h2'>Who owns the data<\/h2>\n<p>This is the part that surprises people. The recorder is built into the car, but the information belongs to you.<\/p>\n<div class='kb-cite'><strong>Ownership:<\/strong> Under the federal Driver Privacy Act of 2015, data retained by an event data recorder is the property of the vehicle&#8217;s owner or lessee. Another party can access it only through a limited set of exceptions, including a court order, the owner&#8217;s consent, a federal investigation, to facilitate medical care after the crash, or de-identified safety research.<\/div>\n<p>In plain terms, the insurance company usually cannot help itself to your car&#8217;s data without your consent or a court order. The same protection applies to the other driver&#8217;s vehicle, which is why a court order or a lawsuit is often how that data gets pulled.<\/p>\n<h2 class='kb-h2'>How the data can help you<\/h2>\n<p>Used the right way, black box data is powerful proof. It can turn a &quot;he said, she said&quot; dispute into a record of what the vehicles actually did.<\/p>\n<ul>\n<li><strong>Speed and braking.<\/strong> The other driver&#8217;s recorder may show a high speed and no braking before impact, which supports your version of events.<\/li>\n<li><strong>The force of the crash.<\/strong> The change-in-velocity figure helps show the collision was strong enough to cause real injury, which matters for the serious-impairment threshold under <a href='https:\/\/www.legislature.mi.gov\/Laws\/MCL?objectName=mcl-500-3135'>\u0a10\u0a2e\u0a38\u0a40\u0a10\u0a32 500.3135<\/a>.<\/li>\n<li><strong>Timing.<\/strong> Throttle and brake data can pin down who reacted and when, which goes to fault.<\/li>\n<\/ul>\n<h2 class='kb-h2'>How the same data can hurt you<\/h2>\n<p>The data cuts both ways. A damaged or repaired car can lose its data, and if you controlled the vehicle and let that happen, the other side may argue you destroyed evidence. Preserving the car, or at least the recorder, protects you.<\/p>\n<h2 class='kb-h2'>Getting the data the right way, and the AI caution<\/h2>\n<p>Black box data has to be pulled by a qualified technician using the correct equipment, then interpreted. In a lawsuit it comes in through the normal discovery process under Michigan Court Rule 2.302, and it has to be authenticated and explained by a competent witness under Michigan Rules of Evidence 901 and 702.<\/p>\n<p>AI tools that read crash data can speed up the analysis, but they are only as good as the inputs and the method behind them. A printout or an AI-generated reconstruction is not automatically correct.
