class=\"kb-lead\">More law firm websites now greet visitors with an AI chatbot that answers questions, screens potential cases, and collects contact details around the clock. For a busy injury practice the appeal is obvious, because a person hurt in a crash often reaches out at night or on a weekend when no one is at the desk. A chatbot that handles that first contact can be a real service. It can also create ethics problems if the firm treats it as marketing software rather than as a tool that speaks for the lawyer. This guide explains how Michigan&#8217;s advertising, solicitation, supervision, and prospective-client rules apply when an AI bot is the first thing a potential client meets.<\/p>\n<h2 class=\"kb-h2\">Advertising or Solicitation? The Line Still Matters<\/h2>\n<p>Michigan draws a line between advertising, which is broadly permitted, and improper solicitation, which is restricted. An on-site chatbot that a visitor chooses to open, can ignore, and can close at any time generally reads as advertising rather than solicitation, because the contact begins with the visitor, so long as the bot does not push individualized, real-time sales pressure about a specific incident. The analysis shifts if the firm turns the bot into an outbound tool that initiates contact with people who did not ask for it. Under MRPC 7.3, a lawyer may not solicit professional employment, for the lawyer&#8217;s pecuniary gain, from a person the lawyer has no family or prior professional relationship with when that person has said they do not want to be contacted, or where the approach involves coercion, duress, or harassment. A chatbot does not get a pass on that rule simply because a machine, not a person, sent the message.<\/p>\n<h2 class=\"kb-h2\">The Bot Cannot Say Anything the Lawyer Could Not<\/h2>\n<p>Everything the chatbot tells a visitor is a communication about the lawyer&#8217;s services, and MRPC 7.1 governs it. That rule forbids a false or misleading communication, including one that contains a material misrepresentation, omits a fact needed to keep the statement from being misleading, or creates an unjustified expectation about results. A bot that tells a worried visitor they &#8220;have a strong case worth six figures&#8221; before any lawyer has looked at the facts is making exactly the kind of statement MRPC 7.1 prohibits. The firm is responsible for that output the same as if a staff member had said it out loud.<\/p>\n<p>Michigan adds a concrete labeling requirement. Effective May 1, 2019, MRPC 7.2(d) requires that lawyer advertising identify at least one lawyer responsible for its content, on the advertisement itself or, where space does not allow, prominently on the firm&#8217;s website. A chatbot interface that markets the firm falls within that expectation, so the responsible lawyer should be identifiable rather than hidden behind an anonymous assistant. In practice that usually means showing the responsible lawyer&#8217;s name within the chat interface itself, or on the page where the bot appears, not buried on a separate page.<\/p>\n<div class=\"kb-cite\"><strong>Three rules to apply before launch:<\/strong> MRPC 7.1 bars false or misleading statements about the firm&#8217;s services. MRPC 7.2(d), effective May 1, 2019, requires identification of a responsible lawyer for advertising. MRPC 7.3 limits solicitation, which matters the moment a bot starts initiating contact rather than answering it.<\/div>\n<h2 class=\"kb-h2\">Supervision: You Own What the Bot Does<\/h2>\n<p>An AI chatbot is nonlawyer assistance, and MRPC 5.3 requires a lawyer to make reasonable efforts to ensure that such assistance behaves in a way compatible with the lawyer&#8217;s own professional obligations. That means the firm has to know what the bot is trained to say, test it for answers that stray into legal advice or overpromising, and monitor it over time rather than setting it loose and forgetting it. Delegating the task to software does not delegate the responsibility.<\/p>\n<p>There is a related boundary the bot must not cross. A chatbot that dispenses individualized legal advice, or implies it is a lawyer, can drift into the unauthorized practice of law and can mislead the public about who, or what, they are dealing with. General legal information is far safer ground than advice tailored to a person&#8217;s specific situation. The safest design tells visitors plainly that they are talking to an automated assistant, not an attorney.<\/p>\n<h2 class=\"kb-h2\">Intake Creates Duties Before You Take the Case<\/h2>\n<p>The moment a chatbot starts asking a visitor about their accident, it is gathering information from someone who may become a prospective client. Under MRPC 1.18, a person who consults a lawyer about possibly forming a relationship is owed a duty of confidentiality even if the lawyer never takes the case, and the information learned in that consultation can create a conflict that disqualifies the lawyer from representing someone on the other side. An intake bot that vacuums up detailed facts from every visitor can therefore generate confidentiality duties, and potential conflicts, on a scale the firm may not be tracking. The firm&#8217;s own retention policy matters too, because a bot that keeps detailed intake transcripts indefinitely can create conflicts and data-breach exposure long after a visitor decides not to hire the firm. For the public, the takeaway is that the firm behind the bot is still fully responsible for what it says and for protecting what you share. If a bot promises a result or pressures you to sign, treat that as a warning sign rather than a service. A statement that promises a result or a dollar figure before a lawyer reviews the facts can be a misleading communication under MRPC 7.1 and an unjustified expectation. Treat any such promise from a bot with caution.<\/p>\n<h3 class=\"kb-h3\">Who is responsible if the chatbot gives bad information?<\/h3>\n<p>The firm. Under MRPC 5.3 a lawyer must supervise nonlawyer assistance, including AI tools, and test and monitor what the bot says. Responsibility does not transfer to the software vendor.<\/p>\n<h3 class=\"kb-h3\">Is the information I type into a firm&#8217;s chatbot confidential?<\/h3>\n<p>It can carry protection. Under MRPC 1.18 a person who consults a lawyer about a possible case is owed confidentiality even if the firm never takes it, and MRPC 1.6 requires the firm to safeguard the data. In some situations, what you tell a chatbot can keep that firm from later representing someone on the other side of your dispute, even if you never become a client. Ask how the information is stored and whether the vendor reuses it.<\/p>\n<h3 class=\"kb-h3\">Does the chatbot have to tell me it is not a real lawyer?<\/h3>\n<p>The sound practice is yes. A bot that answers as though it were an attorney can mislead the public and risk unauthorized practice concerns.
