Miedema<\/em> through <em>White v. Taylor Distributing<\/em> sets a high bar for defendants who try.<\/p>\n<h2 class=\"kb-h2\">The statute, in plain English<\/h2>\n<p>MCL 257.402(a) was enacted as part of the 1949 Michigan Vehicle Code and has not been meaningfully amended since. The text is short and operational: when one vehicle &#8220;overtakes and strikes the rear end of another vehicle proceeding in the same direction, or lawfully standing upon any highway within this state,&#8221; the driver of the striking vehicle is &#8220;deemed prima facie guilty of negligence.&#8221; The subsection extends that rule &#8220;in appropriate cases&#8221; to the owner of the striking vehicle and to the driver&#8217;s employer.<\/p>\n<p>That single sentence does three important things at once. It shifts the production burden onto the rear driver. It supplies the jury instruction (M Civ JI 12.05) used in nearly every Michigan rear-end trial. And it eliminates the need for the plaintiff to prove a specific traffic-code violation &mdash; the impact itself is the trigger.<\/p>\n<div class=\"kb-cite\"><strong>Statutory core:<\/strong> MCL 257.402(a) &mdash; &#8220;In any action, in any court in this state when it is shown by competent evidence, that a vehicle traveling in a certain direction, overtook and struck the rear end of another vehicle proceeding in the same direction&hellip; the driver or operator of such first mentioned vehicle shall be deemed prima facie guilty of negligence.&#8221;<\/div>\n<h2 class=\"kb-h2\">What &#8220;prima facie guilty of negligence&#8221; actually means<\/h2>\n<p>The phrase is a term of art. It does not impose strict liability. It creates a rebuttable presumption that operates as a procedural shortcut: once the plaintiff proves the impact occurred, the burden shifts to the rear driver to come forward with evidence that excuses the collision. If the defendant produces no admissible rebuttal evidence, the presumption stands and directed verdict on negligence is appropriate. If the defendant produces some evidence, the question goes to the jury under M Civ JI 12.05.<\/p>\n<p>The Michigan Supreme Court explained the mechanism in <em>Vander Laan v. Miedema<\/em>, 385 Mich. 226 (1971). The presumption &#8220;is not destroyed by the mere assertion of an explanation.&#8221; It survives the defendant&#8217;s testimony unless the rebuttal evidence is &#8220;clear, positive, and credible.&#8221; On summary disposition, the trial court can find the presumption unrebutted as a matter of law; on a developed record at trial, the question is normally for the jury.<\/p>\n<h2 class=\"kb-h2\">How defendants try to rebut &mdash; and why most fail<\/h2>\n<p>Three theories dominate. None of them is automatic, and the case law has tightened over the past two decades.<\/p>\n<h3 class=\"kb-h3\">Sudden emergency<\/h3>\n<p>The sudden-emergency doctrine excuses the rear driver only when the emergency is &#8220;unusual or unsuspected.&#8221; <em>Vander Laan<\/em>, 385 Mich. at 232. &#8220;Unusual&#8221; means circumstances that &#8220;vary from the everyday traffic routine confronting the motorist.&#8221; Sun glare, light rain, a slowing car ahead, a driver braking for an animal &mdash; none of these qualifies. A semi truck losing its brakes on a dry interstate in clear weather does not qualify either.<\/p>\n<p>The Michigan Supreme Court extended the doctrine in <em>White v. Taylor Distributing Co.<\/em>, 482 Mich. 136 (2008), holding that a truck driver&#8217;s syncopal episode (a sudden blackout) could satisfy the sudden-emergency standard &mdash; but only if the loss of consciousness was &#8220;totally unexpected.&#8221; If the driver felt dizzy or unwell for &#8220;a couple of minutes&#8221; before blacking out, the emergency was of his own making and the presumption stood. <em>White<\/em> is the high-water mark for defendants; it is not a defense template, it is a fact-bound exception.<\/p>\n<h3 class=\"kb-h3\">Sudden stop by the lead vehicle<\/h3>\n<p>The &#8220;he stopped without warning&#8221; defense almost never works. In <em>Hill v. Wilson<\/em> (Mich. Ct. App. 2002, unpublished), the Court of Appeals affirmed summary disposition for the lead vehicle even though the lead driver braked sharply to avoid ducks crossing the road. The presumption holds because the rear driver&#8217;s duty is to maintain enough space to stop for whatever the lead driver does &mdash; expected or not. <em>Garrigan v. LaSalle Coca-Cola Bottling Co.<\/em>, 373 Mich. 485 (1964), is the foundational case on this point: the rear driver&#8217;s failure to maintain adequate following distance is itself the negligence, and a sudden stop ahead does not, without more, &#8220;clearly and positively&#8221; rebut the presumption.<\/p>\n<h3 class=\"kb-h3\">Mechanical failure<\/h3>\n<p>Brake failure, blowouts, and similar mechanical events can rebut the presumption only when the defect was both unforeseeable and unrelated to prior negligent maintenance. A defendant who knew the brakes were soft and kept driving has not &#8220;rebutted&#8221; anything &mdash; he has confirmed the negligence.<\/p>\n<h2 class=\"kb-h2\">The statute applies even when the defendant is uninsured<\/h2>\n<p>A common defense argument &mdash; that an uninsured rear driver should not get a jury instruction on the presumption because he was driving illegally &mdash; was rejected in <em>Estate of Groulx v. Bard<\/em>, decided by the Michigan Court of Appeals in 2018. The Court held that MCL 257.402(a) applies regardless of whether the striking vehicle was covered by a valid no-fault policy. The presumption attaches to the impact, not the insurance status.<\/p>\n<p>This matters for plaintiffs. An uninsured rear driver can still be liable in tort under <a href=\"https:\/\/legislature.mi.gov\/Laws\/MCL?objectName=mcl-500-3135\">\u0a10\u0a2e\u0a38\u0a40\u0a10\u0a32 500.3135<\/a> if the injury meets the serious-impairment threshold. The rear-end presumption gets a plaintiff past summary disposition on duty and breach. It does not prove damages, and it does not prove threshold.<\/p>\n<p>The defense playbook in 2026 is therefore consistent: concede the presumption, fight on threshold, fight on causation, and fight on the percentage of comparative fault assigned to the plaintiff under MCL 600.6304. A plaintiff at 51% comparative fault collects no noneconomic damages. Defense counsel will look hard for distracted driving, sudden lane changes by the plaintiff, or inoperative brake lights.<\/p>\n<h2 class=\"kb-h2\">Practical checklist for the rear-ended plaintiff<\/h2>\n<ul>\n<li><strong>Photograph everything at the scene.<\/strong> Skid marks, debris field, the position of both vehicles before they are moved, and the lead vehicle&#8217;s intact brake lights from a distance the rear driver should have seen.<\/li>\n<li><strong>Get the police report number on scene.<\/strong> The UD-10 report records the officer&#8217;s at-fault determination and any cited civil infractions under MCL 257.627 or MCL 257.643.
