the phone rings. The caller is friendly, says they just need a few details to get your claim moving, and asks if it is okay to record the call. It feels routine, almost like a courtesy. It is not. That adjuster works for an insurance company, and their job is to settle your claim for as little as possible. What you say in that first call can quietly shape, shrink, or even sink your case before you ever understand what it is worth. This guide explains who is really on the other end of the line, what you are and are not required to tell them under Michigan law, the words that come back to hurt people most often, and how to protect yourself without doing anything you are not allowed to do.

First, Know Which Adjuster You Are Talking To

Not every adjuster is the same, and the difference decides how you should handle the call. After a Michigan crash there are usually two very different insurance companies in the picture, and they want opposite things from you.

Your own insurer handles your no-fault claim, also called PIP, which pays your medical care and a share of your lost wages no matter who caused the crash. Because you have a contract with this company, your policy almost always includes a cooperation clause, so you do have a duty to give them reasonable information so they can process your benefits. The other company belongs to the driver who hit you. That is the liability insurer, and it is the one that pays for your pain and suffering only if your case is strong enough. You have no contract with them and no duty to give them a statement at all.

So the same instinct that helps you with one company can hurt you with the other. The trouble is that the caller rarely makes the distinction clear, and a stressed, injured person on day two often does not stop to ask. That single question, “which company do you represent,” is one of the most useful things you can say before you answer anything else.

The key legal point on recorded statements: You are under no legal obligation to give a recorded statement to the at-fault driver’s liability insurer. You are not their customer and you owe them nothing, and politely declining does not hurt your right to bring a claim. Your own insurer is different because of the cooperation clause in your policy, and that duty matters most when you are claiming PIP benefits or making an uninsured or underinsured motorist claim. Even then, you are allowed to slow down, ask to schedule the statement for later, and have a lawyer present when you give it. There is no Michigan statute that forces you to be interviewed on the spot.

Why That Friendly Call Is Not Really a Favor

Adjusters are trained and pleasant, and most are not trying to trick you in an obvious way. The pressure is built into the system, not into any one person. The insurer’s goal is to close your file quickly and cheaply, and an early recorded statement helps them do exactly that. They are looking for three things: a version of events they can use to blame you, an early comment about your injuries they can hold you to, and a quick recorded “yes” to a settlement before anyone knows how serious your injuries really are.

That last point is where people lose the most money. Many injuries from a crash, including disc problems, concussions, and soft-tissue damage, do not show their full severity for days or weeks. If you tell an adjuster early that you feel “fine” or “okay,” that comment can be replayed later to argue you were never badly hurt, even after an MRI proves otherwise. The call is recorded for the insurer’s benefit, not yours.

What You Can Safely Say, and What to Avoid

You do not have to be rude or evasive to protect yourself. You can be polite, brief, and factual while keeping the door closed on the things that get twisted. The table below is a simple guide.

Safe to share

Better to hold back

Your name and contact information

A recorded “official statement” about how the crash happened

The date, time, and location of the crash

Your opinion about who was at fault

That you are getting medical treatment

Guesses about speeds, distances, or details you are unsure of

The names of the vehicles and drivers involved

That you feel “fine,” “okay,” or “better”

That you will follow up in writing or through your attorney

Agreement to any settlement offer, however small

A few short phrases do most of the work. “I am still treating, so I cannot describe my injuries yet.” “I would rather not give a recorded statement today.” “Please put your request in writing.” None of these hurt your claim, and all of them buy you time to understand your case before you commit to anything.

How Your Words Can Be Used Against You Later

This is not about hiding the truth. It is about understanding that anything you say to an insurer can become evidence. Under the rules of evidence, your own statements can be brought back into court as admissions, which means the recorded call from day two can be quoted to the jury months later if your case goes that far. A throwaway “I’m fine” or an off-the-cuff guess that you “might have been going a little fast” is exactly the kind of line an insurer saves to use when the stakes are higher.

Michigan also follows a modified comparative fault rule, and it has real consequences. Under MCL 600.2959, your recovery is reduced by your share of fault, and if you are found more than 50 percent at fault, you cannot collect any pain-and-suffering damages at all. This is why adjusters probe for any admission that shifts blame onto you. Shifting just enough fault can shrink, or wipe out, the most valuable part of your claim. You can read more in our guide to the 51 percent comparative fault bar.

Watch Out for the Medical Authorization Form

Early in the process, an adjuster may mail or email a medical authorization and ask you to sign it so they can “get your records.” Read it carefully before you sign anything. A broad authorization can hand the insurer access to your entire medical history, not just the records tied to this crash. They then comb through years of unrelated visits looking for any old ache or prior injury they can blame your current pain on. You can limit what you release to records that are actually relevant, and you do not have to sign a blanket form just because it arrived with a friendly note. When a lawyer handles your claim, the records that go to the insurer are gathered and controlled, not handed over wholesale.

Cooperating With Your Own Insurer Without Oversharing

Because your own no-fault insurer pays your PIP benefits, you do need to work with them, and stonewalling your own company can delay the medical and wage benefits you are counting on. The goal is reasonable cooperation, not a free-form interview. You can provide the basic facts, submit your medical bills and wage information, and answer fair questions about your treatment while still declining to speculate about fault or to give an open-ended recorded statement without preparation. If your own company is the one paying, keeping your claim moving also protects you against missed deadlines, including the one-year written notice rule for no-fault benefits under MCL 500.3145. For crashes on or after June 11, 2019, the period for collecting past benefits pauses once you submit a specific claim and stays paused until the insurer formally denies it, but you should never rely on that pause as a reason to wait.

Do not let the clock run out: Talking, or not talking, to an adjuster never pauses the deadlines that govern your case. In most Michigan injury cases you have three years from the date of the crash to sue the at-fault driver under MCL 600.5805(2), and a separate one-year written notice rule under MCL 500.3145 applies to your no-fault benefits. Friendly settlement talks do not stop either clock. If a government vehicle or a government road defect was involved, even shorter notice deadlines can apply. The safest move is to learn your deadlines early, while the evidence is still fresh.

Do You Need a Lawyer Before You Call Back?

You are allowed to handle your own claim, and for a minor fender-bender with no injuries you may not need anyone. When you are actually hurt, the math changes. Once you have a lawyer, the adjusters call your office instead of your phone, your statements are prepared rather than improvised, your records are controlled, and the insurer can no longer count on catching you off guard. Talking to an attorney early does not commit you to a lawsuit and does not cost you anything up front. It simply means you stop facing a trained adjuster alone. Most injury attorneys, including this office, work on a contingency fee, so there is no fee unless we recover money for you.

संबंधित ज्ञानकोश लेख

What To Do After a Car Accident in Michigan . Comparative Fault and the 51 Percent Bar . Will No-Fault Pay Your Medical Bills? . Michigan Injury Deadlines and the Statute of Limitations

अक्सर पूछे जाने वाले प्रश्न

Do I have to give a recorded statement to the other driver’s insurance company?

No. You have no contract and no legal duty to the at-fault driver’s liability insurer, so you do not have to give them a recorded statement at all. You can politely decline, and it will not hurt your right to bring a claim. It is usually best to speak with your own attorney before giving any statement to that company.

What about my own insurance company?

Your own no-fault insurer is different because your policy includes a cooperation clause, so you do need to provide reasonable information for your PIP claim. Even so, you can schedule the statement for later, prepare for it, and have a lawyer present. Cooperating does not mean giving an unprepared, open-ended recorded interview on the first call.

Can what I say to an adjuster really be used against me?

Yes. Your own statements to an insurer can come back as admissions and be quoted later if your case goes to court. An early “I’m fine” or a guess about your speed can be replayed to argue you were not badly hurt or were partly at fault. That is why brief, factual answers protect you far better than casual conversation.

Should I sign the medical authorization the adjuster sent me?

Be careful. A broad authorization can open your entire medical history to the insurer, who will look for old injuries to blame your current pain on. You can limit what you release to records related to this crash, and you do not have to sign a blanket form. A lawyer can control which records go to the insurer.

Will refusing to talk make me look guilty or hurt my claim?

No. Declining a recorded statement to the at-fault insurer is your right and is common practice. It does not make you look guilty, and it does not pause any deadline. What hurts claims is the opposite, an early unprepared statement that the insurer uses later.

When should I call a lawyer instead of the adjuster?

If you were injured, before you give any detailed or recorded statement. Once you have an attorney, the insurer deals with your lawyer instead of you, your statements are prepared, and your deadlines are protected. The consultation is free, and most injury lawyers, including this office, charge no fee unless they recover money for you.

Got a call from an adjuster?
